Josh B. Arons is Counsel in our Powering Affordable Clean Energy (PACE) practice for the U.S. Department of Agriculture and advises institutional investors in connection with new markets tax credits (NMTC) transactions.

Mr. Arons is an experienced transactional attorney representing clients in sophisticated commercial real estate transactions nationally and in the District of Columba metropolitan area involving the acquisition, disposition construction and development of commercial real estate and renewable energy projects. Mr. Arons has experience representing major institutional tax credit investors, developers, and community development entities (CDEs) in NMTC transactions utilizing state and federal tax credits in connection with commercial, industrial, mixed-use and retail properties.

Mr. Arons obtained his Bachelor of Arts in Political Science from the University of Massachusetts Amherst Commonwealth Honors College. Mr. Arons obtained his Juris Doctorate from the American University Washington College of Law, where his Law Review Article was published in the Transportation Law Journal and was cited an amicus brief granted writ of certiorari by the United States Supreme Court.

Prior to joining MA, Mr. Arons was an Associate at an AmLaw 200 Law Firm in Washington, D.C., at a mid-size firm in Boston, Massachusetts, and clerked at the Montgomery County, Maryland Circuit Court.

Mr. Arons is licensed to practice law in Maryland, the District of Columbia, and Massachusetts.

  • Represented administrative agent for funding lenders in connection with a $51,700,000 tax-exempt bond and credit facility with a governmental housing finance agency. The bond proceeds were used to make a project loan to the borrower to secure a 4% low-income housing tax credit allocation. The credit facility was secured by the governmental housing finance agency’s, borrower’s, and guarantor’s leasehold interest in the property.
  • Represented administrative agent for senior and mezzanine lenders in connection with a $500,000,000 combined senior and mezzanine loan facility.
  • Represented NMTC investor in connection with the $21,706,000 acquisition, construction, and development of an integrated workforce training center, education center, and sub-lease of an apartment building to third-party tenants.
  • Represented NMTC investor in connection with the $7,760,000 re-development of a multi-building community health care facility.
  • Represented CDE in connection with a $8,624,000 project loan concerning the construction of precast multi-family homes.
  • Represented lender in connection with a solar rooftop and carport lease located in an office-park complex.
